(1) şi ale art. 110 din Legea apelor nr. 107/1996, cu modificările şi completările ulterioare, ale art. 3 şi 10 din Programul de eliminare treptată a evacuărilor, emisiilor şi pierderilor de substanţe prioritar periculoase, aprobat prin Hotărârea Guvernului nr. 351/2005, în temeiul art. 5 alin. (8) din Hotărârea Guvernului nr. 408/2004 privind organizarea şi funcţionarea Ministerului Mediului şi Gospodăririi Apelor, cu modificările şi completările ulterioare, având în vedere Referatul de aprobare nr. 826/S.B./2006, ministrul mediului şi gospodăririi apelor emite prezentul ordin. Art. 1. – Se aprobă Normativul privind clasificarea calităţii apelor de suprafaţă în vederea stabilirii stării ecologice a corpurilor de apă, prevăzut în anexa*) care face parte integrantă din prezentul ordin. ___________ *) Anexa se publică ulterior în Monitorul Oficial al României, Partea I, nr. 511 bis în afara abonamentului, care se poate achiziţiona de la Centrul pentru relaţii cu publicul al Regiei Autonome "Monitorul Oficial", Bucureşti, şos. Panduri nr. 1. Art. 2. – Prevederile normativului menţionat la art. 1 se aplică la toate apele de suprafaţă, inclusiv apele marine de coastă. Art. 3. – La data intrării în vigoare a prezentului ordin se abrogă Ordinul ministrului apelor şi protecţiei mediului nr. 1.146/2002 pentru aprobarea Normativului privind obiectivele de referinţă pentru clasificarea calităţii apelor de suprafaţă, publicat în Monitorul Oficial al României, Partea I, nr. 197 din 27 martie 2003, şi "STAS 4706/1988 – Ape de suprafaţă – Categorii şi condiţii de calitate" referitor la standardele de calitate pentru caracterizarea apelor marine costiere. Art. 4. – Prezentul ordin se publică în Monitorul Oficial al României, Partea I. Ministrul mediului şi gospodăririi apelor, Sulfina Barbu ANEXĂ NORMATIV privind clasificarea calităţii apelor de suprafaţă în vederea stabilirii stării ecologice a corpurilor de apă Art. 1 (1)Se aprobă lista de elemente de calitate biologice, hidromorfologice, chimice şi fizico-chimice în vederea stabilirii stării ecologice a ecosistemelor acvatice continentale – râuri şi lacuri, naturale şi artificiale sau modificate ireversibil, prevăzută în tabelul nr. 1. (2)Se aprobă lista de elemente de calitate microbiologice, chimice şi fizico-chimice şi standardele de calitate în vederea stabilirii stării ecologice a ecosistemelor acvatice marine, prevăzută în tabelul nr. 2. (3)Stabilirea stării ecologice a ecosistemelor acvatice continentale trebuie să se facă pe baza elementelor de calitate biologice, ţinând cont şi de indicatorii hidromorfologici, chimici, fizico- chimici şi de poluanţi specifici care influenţează indicatorii biologici. Evaluarea acestor elemente poate arăta prezenţa condiţiilor naturale, alterări minore ale acestora sau amploarea impactului antropic si, respectiv, starea calităţii corpurilor de apă într-o anumită perioadă de timp. (4)Elementele biologice care stau la baza evaluării stării ecologice pentru Dunăre şi râurile mari vor fi luate în considerare conform următoarei ierarhizări: 1.fitoplacton; 2.fitobentos; 3.macrozoobentos; 4.macrofite/angiosperme; 5.peşti (5)Se stabilesc 5 stări ecologice pentru râuri şi lacuri naturale: foarte bună (I), bună (II), moderată (III), slabă (IV) şi proastă (V), pe baza elementelor de calitate biologice, hidromorfologice, chimice şi fizico-chimice prevăzute la alin. În baza prevederilor art. 21 alin. (1) şi ale art. 110 din Legea apelor nr. 107/1996, cu modificările şi completările ulterioare, ale art. 3

şi 10 din Programul de eliminare treptată a evacuărilor, emisiilor şi pierderilor de substanţe prioritar periculoase, aprobat prin Hotărârea

Guvernului nr. 351/2005, în temeiul art. 5 alin. (8) din Hotărârea Guvernului nr. 408/2004 privind organizarea şi funcţionarea Ministerului

Mediului şi Gospodăririi Apelor, cu modificările şi completările ulterioare, având în vedere Referatul de aprobare nr. 826/S.B./2006,

ministrul mediului şi gospodăririi apelor emite prezentul ordin.

Art. 1. – Se aprobă Normativul privind clasificarea calităţii apelor de suprafaţă în vederea stabilirii stării ecologice a corpurilor de

apă, prevăzut în anexa*) care face parte integrantă din prezentul ordin.

standardele de calitate pentru caracterizarea apelor marine costiere.

Art. 4. – Prezentul ordin se publică în Monitorul Oficial al României, Partea I.

Art. 1(1)Se aprobă lista de elemente de calitate biologice, hidromorfologice, chimice şi fizico-chimice învederea stabilirii stării ecologice a ecosistemelor acvatice continentale – râuri şi lacuri, naturale şiartificiale sau modificate ireversibil, prevăzută în tabelul nr. 1.(2)Se aprobă lista de elemente de calitate microbiologice, chimice şi fizico-chimice şi standardele decalitate în vederea stabilirii stării ecologice a ecosistemelor acvatice marine, prevăzută în tabelul nr.2.(3)Stabilirea stării ecologice a ecosistemelor acvatice continentale trebuie să se facă pe bazaelementelor de calitate biologice, ţinând cont şi de indicatorii hidromorfologici, chimici, fizico-chimici şi de poluanţi specifici care influenţează indicatorii biologici. (6)Pentru ecosistemele acvatice artificiale sau modificate ireversibil se stabilesc: potenţialul ecologicfoarte bun (E), bun (B), sau moderat (M).

Art. 2(1)În procesul de stabilire a stării ecologice sau a potenţialului ecologic a ecosistemelor acvatice,naturale sau artificiale, evaluarea elementelor biologice se face:a)pentru râuri – pe baza listei de bioindicatori prevăzută în tabelul nr. 3;b)pentru lacuri pe baza listei de bioindicatori prevăzută în tabelul nr. 4;c)calcularea indicelui saprob – pe baza listei de indicatori cu valori saprobe prevăzută în tabelul nr.5.

(2)Listele prevăzute în tabelele 3-5 vor fi modificate şi completate pe măsura identificării de noibioindicatori şi vor fi aprobate prin ordin al ministrului mediului şi gospodăririi apelor;(3)Lista de elemente biologice prevăzută la art. 2 alin. (1) se referă la ecosisteme acvatice lotice saulentice, fără includerea torenţilor, lacurilor glaciare şi lacurilor sărate.

Art. 3(1)Evaluarea elementelor de calitate chimice şi fizico-chimice, pe baza standardelor de calitateprevăzute în tabelul nr. 6, se face în sprijinul procesului de stabilire a stării ecologice a diferitelortipuri de ecosisteme acvatice, naturale sau artificiale.(2)Standardele de calitate pentru elementele de calitate chimice şi fizico-chimice prevăzute la art. 3alin. (1) asigură încadrarea în cele 5 stări ecologice şi atingerea valorilor elementelor biologice decalitate aferente fiecărei stări.(3)Stabilirea stării de calitate a diferitelor categorii de ape se face numai pe baza indicatorilor decalitate corelaţi cu diferitele utilizări ale apei, din legislaţia în vigoare, prevăzuţi în tabelul nr.7;(4)Elementele de calitate chimică şi fizico-chimică din grupa "Salinitate", respectiv calciu, magneziu,sodiu, potasiu, reprezintă substanţe de origine naturală şi nu indică poluare.(5)Acolo unde poluarea chimică este responsabilă pentru deteriorarea stării ecologice, şi nu lucrărilecare modifică elementele hidromorfologice, trebuie să se stabilească poluantul sau poluanţii de naturăchimică care constituie cauza deteriorării, în vederea acţionării asupra nivelului poluantului pentrureducerea impactului, evidenţiat de depăşirea standardului de calitate.(6)Indicatorii de microbiologie din tabelul nr. 6, grupa D, se vor analiza numai în cazul apelor brutedestinate potabilizării, a apelor de îmbăiere şi a apelor care formează sau traversează frontiera de statmonitorizate în cadrul convenţiilor internaţionale; evaluarea calităţii acestor ape se va face înconformitate cu standardele de calitate prevăzute pentru aceste utilizări ale apei;

Art. 4(1)Stabilirea stării chimice a ecosistemelor acvatice continentale, râuri şi lacuri, naturale şiartificiale sau modificate, se face pe baza standardelor de calitate pentru apă şi sedimente aleindicatorilor prevăzuţi în tabelul nr.8; standardele de calitate pentru biota sunt cele prevăzute în OM44/2004 pentru aprobarea Regulamentului pentru realizarea monitoringului calităţii apelor pentrusubstanţe prioritare/prioritar periculoase.(2)Se stabilesc 2 stări chimice: starea chimică bună – încadrarea în standardele de calitate pentru apapentru indicatorii prevăzuţi la alin. (1) şi starea chimică proastă depăşirea acestor standarde.(3)In situaţia existenţei, în tabelul nr. 8, a două valori diferite a standardelor de calitate a apei, seconsideră:a)pentru metale – valoarea mai mică se referă la elementul ca atare şi valoarea mai mare se referă lasuma metalului şi a compuşilor acestora, în cazul utilizării metodelor de analiza care asigură specierea,respectiv spectrometria de masă cu plasmă cuplată inductiv (ICP-MS); în cazul utilizării metodei despectrometrie de absorbţie atomică se ia în considerare valoarea mai mare;b)în cazul substanţelor organice de sinteză – se ia în considerare valoarea mai mică, care reprezintăvaloarea de evaluare în cazul existenţei presiunilor punctiforme şi valoarea mai mare este valoarea deevaluare în cazul existenţei presiunilor punctiforme şi difuze;

(4)Standardele de calitate pentru sedimente se referă la sedimente cu conţinut standard de 10% materieorganică şi sunt prevăzute în tabelul nr. 8;(5)Standardele de calitate pentru biota alge, moluşte, peşti trebuie să respecte o 'Valoare constantă" întimp şi să nu depăşească valoarea factorului de bioconcentrare (BCF) pentru respectivul indicator;(6)Pentru alte substanţe decât cele din tabelul nr. 8, prevăzut la art. 4 alin. (1) sau pentrusubstanţele incluse în tabelul nr. 8 pentru care nu sunt prevăzute standarde de calitate, starea chimicătrebuie să se stabilească pe baza metodologiei de evaluare de risc şi de impact pentru apă, sediment,biota, în conformitate cu prevederile legislaţiei în vigoare.(7)Starea chimică bună se atinge în cazul în care toţi indicatorii de calitate care caracterizează stareachimică se înscriu în standardele de calitate pentru apă, sediment sau biota.

Art. 5(1)Elementele de calitate chimice şi fizico-chimice şi standardele de calitate pentru caracterizareacalităţii apelor marine costiere sunt prevăzute la art. 1 alin. (2).(2)Standardele de calitate prevăzute la alin. (1) au scopul de a conserva şi a asigura condiţiilefavorabile resurselor de apa marină de coastă pentru o utilizare normală şi a asigura atingerea stăriiecologice bune a ecosistemelor marine de coastă.(3)Standardele de calitate stabilite pentru "zona de impact antropic", prevăzute la art. 1 alin. (2) auscopul de a asigura condiţiile cerute de utilizarea durabilă a ecosistemelor marine costiere în zonele cesuporta impactul apelor uzate evacuate în mediul marin.(4)Standardele de calitate ale substanţelor periculoase şi prioritare/prioritar periculoase pentruatingerea stării chimice bune sunt cele prevăzute în Hotărârea Guvernului nr. 351/2005 privind aprobareaProgramului de eliminare treptată a evacuărilor, emisiilor şi pierderilor de substanţe prioritarpericuloase; încadrarea în standardele de calitate precizate conduce la atingerea stării ecologice

"bune"; valoarea "zero" a standardelor de calitate sau sub limita de detecţie a celor mai bune tehniceutilizate în majoritate conduc la încadrarea în starea ecologică 'Toarte bună".(5)În cazul unei evacuări constante sau periodice în mediul marin a unei substanţe pentru care nu estestabilit standard de calitate în tabelul prevăzut la alin. (1), autoritatea publică centrală pentrugospodărirea apelor va stabili standardul de calitate, pe baza metodologiei de evaluare de risc şi deimpact prevăzută în OM 245/2005 şi procedura de monitorizare; metodologia de evaluare de risc şi deimpact pentru substanţe noi este realizată de institute de cercetare acreditate în domeniu, pe baza unuicontract cu evacuatorul respectivei substanţe.(6)Standardele de calitate de radioactivitate pentru apele marine de coastă corespund normelor învigoare.(7)Valorile indicatorilor prevăzuţi la art. 1. alin.(l) vor fi stabilite prin analize şi măsurători,efectuate de laboratoare acreditate în domeniul mediului, utilizând metode standard naţionale saueuropene recomandate pentru respectivul indicator.

Art. 6(1)Evaluarea elementelor de calitate biologice, chimice şi fizico-chimice în vederea stabilirii stării decalitate biologice şi chimice a apei, se va face:a)pe baza mediei aritmetice şi a deviaţiei standard, în cazul unui volum de selecţie de date mai mic de30;b)pe baza valorii tipice de 90 percentile, respectiv 10 percentile pentru "oxigenul dizolvat", însituaţia unui volum de selecţie de date mai mare sau egal cu 30.

(2)Datele utilizate în evaluarea stării ecologice şi chimice trebuie să provină din probe compozite, curespectarea recomandărilor minime privind prelevarea probelor compozite, transportul şi conservareaacestora cuprinse în seria SR ISO 5667 2002; în cazul utilizării altor standarde de prelevare, conservareşi transport, acestea trebuie să atingă cel puţin aceleaşi performanţe de precizie şi acurateţe custandardul recomandat.
