RESPONSABILITATEA JURIDICĂ:
NOŢIUNE, CORELAŢII, CADRU DE
MANIFESTARE ŞI EFECTE

Abstract: Sub aspect lingvistic şi la nivelul
limbajului comun termenul „responsabilitate” apare
ca fiind echivalent cu cel de “răspundere”, definindu-
se unul prin celălalt, ceea ce nu corespunde realităţii.
Astfel, pe când termenul “responsabilitate” constituie
obiect de preocupare pentru sociologie şi se află în
strânsă corelaţie cu fundamentarea acţiunii sociale,
cel de “răspundere” vizează domeniul juridico-moral.
Interesând doar arealul juridico-moral, fenomenul
“răspundere” nu a fost analizat în ansamblul său, ci
doar fragmentar, vizând, cu precădere, formele
răspunderii juridice prin prisma diferitelor ramuri de
drept.
Responsabilitatea ca valoare se originează în
profunzimea vieţii spirituale a omului şi are
deopotrivă rădăcini biologice şi sociale cu evoluţie
corespunzătoare devenirii umane de la începuturi şi
până astăzi.
Responsabilitatea implică un raport între
individ şi colectivitate, individul percepându-l din
interior, ca ceva voit şi interesat, pe când
răspunderea comportă, mai ales, un raport între
autoritatea unei colectivităţi şi individ şi pe care
acesta îl resimte ca pe ceva exterior.
Deşi distincte prin natură, conţinut şi grad
de integrare, responsabilitatea şi răspunderea sunt
legate între ele, întrucât ambele vizează raportul
dintre individ şi colectivitate şi sunt forme de
integrare a individului în societate.

1. Preliminarii
Sub aspect lingvistic, dar şi la
nivelul limbajului comun, termenii de
răspundere şi responsabilitate sunt
echivalenţi, fiind definiţi unul prin celălalt.

Abstract: Under linguistic aspect and at the
common language level the term "responsibility"
appears to be equivalent to that of "liability", defining
one by the other, which does not correspond to the
reality. Thus, whereas the term "responsibility" is
object of concern for sociology and is in close
correlation with the foundation of the social action
that of "liability" covers the legal and moral area.
Interesting only the legal and moral areal, the
phenomenon of "liability" was not analysed on its
whole, but only in fragmented way, aimed, in
particular, the forms of legal liability in the light of
the different branches of law.
Responsibility as value originates in the
depth of the spiritual life of man and has both
biological and social roots with appropriate
development of human becoming from the beginnings
until today.
Responsibility implies a ratio between the
individual and collectivity, individual perceiving it
from inside, as something willed and interested, while
the responsibility involves above all a report between
the authority of a collectivity and individual and
which this feels like something outside.
Although distinct by nature, content and
degree of integration, the responsibility and the
liability are interconnected, since both aim the
relationship between the individual and the
collectivity and are forms of integration of the
individual into the society.

1. Preliminaries
Under linguistic aspect, but also at
the common language level, the terms of
liability and responsibility are equivalent,

Astfel, Dicţionarul Explicativ al
Limbii Române defineşte răspunderea ca
fiind: „faptul de a răspunde, obligaţia de a
răspunde de îndeplinirea unei acţiuni,
sarcini etc.; responsabilitate”1, iar
responsabilitatea ca fiind: „obligaţia de a
efectua un lucru, de a răspunde, de a da
socoteală de ceva; răspundere”2.
În limba franceză, respectiv în
Dicţionarul Larousse3 termenul
„responsabilitate” din limba română nu are
echivalent. Singurul termen cunoscut este
acela de răspundere, respectiv „La
responsabilite” care desemnează obligaţia
de a repara daunele cauzate altuia de către
el însuşi, de către o persoană care depinde
de el, sau de către un animal sau lucru aflat
în paza sa; obligaţia de a suporta pedeapsa
prevăzută pentru infracţiunea comisă .
Spre deosebire de dicţionarele mai
vechi de filozofie4 care nu acordă niciun
spaţiu acestor termeni, dicţionarele relativ
recente de filozofie5, ca de altfel şi cele
vizând sfera social-politică6 afectează
spaţiu termenului de responsabilitate
precizând între altele că responsabilitatea
se deosebeşte de răspundere prin aceea că
„răspunderea priveşte comportarea omului
în limitele unui sistem de norme dictat de
societate”, iar „responsabilitatea se referă
la autoangajarea liber consimţită,
obligaţie izvorâtă din sistemul de norme
devenind o datorie pe care şi-o impune
individul (sau colectivitatea) prin
autoconstrângere”7.
Dimpotrivă, dicţionarele din sfera
juridică acordă atenţie termenului de
răspundere, ignorând pe cel de
responsabilitate.
Reţinând fie şi numai cele relevate
se impune să evidenţiem realitatea concretă
şi distinctă a celor două fenomene care
reliefează faptul că cei doi termeni nu sunt
echivalenţi sub aspectul modului în care au
fost analizaţi, termenul de răspundere a
vizat domeniul juridico-moral, fapt ce a
făcut ca fenomenul „răspundere” să nu fie
analizat în ansamblul său, ci doar

Romanian Language defines the liability as
being: “the fact of having a responsibility,
the obligation of being responsable for the
performance of an action, task etc.;
responsibility”21
and the responsibility as
being: “the obligation of performing an
action, of being responsable or accounting
for something; liability”22
.
In French, namely in Larousse
Dictionary23
, the term “responsibility” in
Romanian has no equivalent. The only
known term is that of liability, namely “la
responsabilite” which designates the
obligation of repairing the damages caused
by oneself to someone else, by a person
depending on one, or by an animal or thing
being under one's control; the obligation to
execute the penaly provided for the
infringement committed.
As opposed to the ancient
dictionaries of philosophy24
which do not
define these terms, the relatively new
dictionaries of philosophy25
and those
concerning the social and political sphere26
,
allow some space to the term of
responsability, stating, inter alia, that
responsibility differs from liability by
reason of the fact that “liability concerns
the man behaviour within the limits of a
system of rules dictated by the society” and
“responsibility refers to a voluntary self-
commitment, obligation sprung from the
system of rules, becoming a duty that the
individual (or the collectivity imposes by
self-contraint)”27
.
On the contrary, legal dictionaries
pay attention to the term of liability,
ignoring the term of responsibility.
Taking into consideration only the
above-mentioned aspects, it is necessary to
highlight the tangible and distinct reality of
the two phenomena which underlines the
fact that these two terms are not equivalent
regarding how they have been analysed, the
term of liability targeted the legal and moral
area, leading the phenomenon of‚ liability’

fragmentar, vizând cu precădere formele
răspunderii juridice, prin prisma diferitelor
ramuri de drept, iar cel de responsabilitate
constituind obiect de preocupare pentru
sociologie în strânsă corelaţie cu
fundamentarea teoriei acţiunii sociale.
Realitatea concretă a celor două
fenomene implică existenţa unor premise
care le-au determinat apariţia, a unor
condiţii care le-au mijlocit evoluţia şi le-au
determinat complexitatea.
Reliefarea acestor premise ne
conferă posibilitatea situării răspunderii şi
responsabilităţii într-un cadru care nu poate
fi decât de natură socială, întrucât ambele
privesc fiinţa umană, comportamentul
acesteia.
Fără a intra în detaliile istoricului
constituirii responsabilităţii relevăm că
filosofia şi sociologia contemporană au
reluat această problematică care este tratată
din perspectiva acţiunii sociale, în corelaţie
cu alte componente de bază precum:
decizia, eficienţa, ca o consecinţă a
preocupărilor interdisciplinare, cu vădit
caracter sociologic şi praxiologic,
gnoseologic şi axiologic, etic şi juridic,
materializat mai ales în teoria organizării şi
conducerii8.
Fenomenul responsabilităţii sociale
a parcurs un drum paralel cu cel al
valorizării datului natural al omului9.
Astfel, în cadrul formelor primare
de comunitate socială umană respectiv al
familiei, gintei, fratriei şi tribului se
manifestă sentimentul solidarităţii cu
ceilalţi, al datoriei, al răspunderii şi
responsabilităţii individului pentru
activitatea sa în cadrul colectivităţii în
cadrul unor raporturi interumane concrete.
În timp se constituie ca formă de
comunitate poporul ceea ce face ca
individul să devină concomitent şi membru
al acestei entităţi sociale şi să dobândească
sentimentul şi conştiinţa că aparţine şi
acestei forme de comunitate. În acest
context sentimentul responsabilităţii se
diversifică în raport cu aceste forme de

The tangible reality of these two
phenomena implies the existence of some
premises which determined their
occurrence, of some conditions which
mediated their development and determined
their complexity.
The emphasis on these premises
allows us to place liability and
responsibility in a framework which can
only be social, because both concern the
human being, the human being's behavior.
Without entering into details on the
history of how the responsibility was built,
we reveal that philosophy and contemporary
sociology continued the studies on this issue
which is approached from the social action
perspective, in correlation with other
essential parts such as: decision, efficiency,
as a consequence of the interdisciplinary
concerns, that Eire clearly sociological and
phraseological, gnoseological and
axiological, ethical and legal, particularly
materialized in the organization and
management theory28
.
The phenomenon of social
responsibility has come a way parallel to
that of valuing the human natural
endowment29
.
Thus, within the primary forms of
human social community such as family,
gens, sibling and tribe, the feeling of
solidarity, duty, liability and responsibility
of the individual is expressed for his activity
in the community, in case of specific human
relationships.
Then gradually the nation is
established as community form, fact which
makes the individual to become at the same
time a member of this social entity and to
acquire the feeling and the consciousness of
belonging to this community form. In this
context, the feeling of responsibility varies

comunitate.
Cu timpul ginta, fratria şi tribul
dispar, rămânând familia şi poporul.
Pe cale de consecinţă putem
conchide că cele mai vechi forme de
responsabilitate socială sunt cea familială
bazată pe factori de natură socială,
psihologică şi chiar biologică, precum şi
cea faţă de popor ca autentic socială.
Odată cu constituirea popoarelor a
apărut organizarea statală, ceea ce a condus
la naşterea unei responsabilităţi civice faţă
de stat. Acum individul dobândeşte statutul
de cetăţean cu drepturi şi îndatoriri
specifice ceea ce îi conferă posibilitatea
manifestării unei atitudini responsabile
pentru soarta ţării sale ca popor şi stat.
La rândul său, constituirea naţiunii a
condus şi la apariţia şi dezvoltarea
responsabilităţii naţionale.
2. Resorturile şi definirea
responsabilităţii sociale şi juridice şi a
răspunderii sociale şi juridice
Responsabilitatea ca dimensiune a
individului, este un concept de ordin
valoric10
ce trebuie centrat în existenţa
individului, fiind legată de viaţa sa
spirituală, şi face parte din resortul
sentimente şi atitudini şi se exprimă prin
ceea ce numim comportament uman.
Pentru descoperirea premiselor sale
resorturile sociale sunt insuficiente
impunându-se cercetarea şi aprofundarea
vieţii spirituale a omului, al cărui
fundament îl constituie „trăirea” ca
rezultat al complexităţii organizării pe plan
psihologic.
Din punct de vedere ştiinţific
fenomenul trăire, cel puţin până acum nu
poate fi explicat. El ar putea fi o deschidere
către zonele de constituire a legilor întrucât
aşa cum afirmă M. Drăgănescu11
, până în
prezent ştiinţa s-a ocupat doar de
descoperirea legilor, nu şi de cercetarea
unei zone de constituire a acestora.
Oricum, este cert că în sfera trăirii
intră percepţiile individuale sau colective

As a consequence, we may conclude
that the oldest forms of social responsibility
are the family responsibility based on
social, psychological and even biological
factors, and the responsibility towards the
nation as being genuinely social.
In time with the establishment of
nations, it appeared the polity, leading to the
civic responsibility towards the state. At
that stage, the individual acquires the status
of citizen with specific rights and duties
which gives him the possibility to express a
responsible attitude for his country's future
as nation and state.
For its part, the nation establishment
also led to the appearance and development
of the national responsibility.
2. Areas and definition of social
and legal responsibility and of social
liability
Responsibility, as a dimension of the
individual, is a concept of value order30
which has to be placed in the center of the
individual existence, being linked to his
spiritual life, it is part of the area feelings
and attitudes and it is expressed by what we
called human behavior. In order to discover
his premises, social areas are not sufficient,
leading to the analysis and the thoroughness
of the human spiritual life, whose basis is
represented by the “experience” as a result
of the organization complexity from a
psychological point of view.
Scientifically, the phenomenon of
experience, at least so far, cannot be
explained. It could be an opening to the
zones of laws establishment because, as M.
Drăgănescu31
, the concerns of the science
until now were to descover laws, not to
analyze one of their establishment zones.
Anyway, it is obvious that the
individual or collective perceptions which
generate some representations which, in

care generează anumite reprezentări, care
la rândul lor sunt convertite în valori.
Ori, din cele mai vechi timpuri şi
pretutindeni, cele mai diferite valori au fost
raportate la noţiunile de „bine”12
şi
„rău”13
, termeni polari ce aparţin
limbajului axiologic, moral şi universal.
Pornind de la aceste valori, care
apar ca primare în raport cu fiinţa umană,
s-a afirmat că răspunderea se leagă de
„rău” iar responsabilitatea de sistemul
valoric ce se creează în jurul binelui şi
răului.
Sub aspect social, „binele” se
analizează printr-o conformitate la o
regulă, iar „răul” reprezintă
neconformitatea la regula respectivă.
Pornind de la dubla apartenenţă a
omului la „o lume a naturii”şi la „o lume a
culturii” putem înţelege că
responsabilitatea ca valoare se originează
în profunzimea vieţii spirituale a omului
având rădăcini deopotrivă biologice şi
sociale cu evoluţie corespunzătoare
devenirii umane, de la începuturi şi până
astăzi.
Sentimentul responsabilităţii s-a
creat în jurul valorii pe care astăzi o numim
dreptate, dar care la origini poate fi
apropiată de instinctul de conservare a
omului în forma sa de apărare, când
dreptatea şi nedreptatea erau noţiuni
extrem de apropiate, percepţia lor nefiind
sesizabilă fiinţei umane întrucât scopul
conservării vieţii omului şi a bunurilor
acestora scuza mijloacele folosite.
Diferenţierea dintre dreptate şi
nedreptate ţine tocmai de trecerea de la
reprezentare la valoare şi apoi la normă.
Reprezentările devenind colective
se transformă într-un sistem de valori
coerent şi se cristalizează sub formă de
norme ce sunt impuse ca reguli de
organizare şi comportament tuturor
oamenilor din cadrul societăţii date.
Astfel norma devine un instrument
de subordonare a individului faţă de
societatea în care trăieşte.

Or, from the oldest times and
everywhere, the most different values were
reported to the notions of “good"32
and
“bad"33
, polar terms belonging to the
axiological, moral and universal language.
Starting from these values,
appearing as primary in relation to the
human being, they stated that the liability is
related to the "bad" and the responsibility is
related to the values systems created around
the good and the bad.
From the social point of view, the
"good" shall be analyzed by a compliance
with a rule, and the "bad" represents the
noncompliance with that rule.
Starting from the double
appurtenance of man to‚ a world of the
nature’ and‚ a world of the culture’ we
may understand that the responsibility as
value is originated in the deepness of the
spiritual life of the man, having roots both
biological and social with the evolution
corresponding to the human becoming, from
the beginnings until today.
The feeling of responsibility was
created around the value that we call today
righteousness, but which may be initially
closed to the preservation instinct of man
as defense, when right and wrong were
notions extremely closed, their perception
not being distinguishable for the human
being, as the purpose of preserving the
man's life and their goods justifies the used
means.
The difference between right and
wrong is related to passing from the
representation to the value and then to the
rule.
Representations become collective
and are transformed into a coherent system
of values, crystalized as norms imposed as
rules of organization and behavior for all
men within the given society.
Thus, the norm becomes a
subordination instrument of the individual
face to the society where they live.

Datorită organizării în sistem,
societatea apare structurată şi direcţionată
lucru ce se realizează prin procese
complexe ce se desfăşoară la mai multe
nivele, ce pot fi reduse, în esenţă la trei: cel
existenţial, cel politic şi cel juridic14
.
Premisele responsabilităţii sunt atât
de ordin social cât şi biologic, iar sub
aspectul evoluţiei, fenomenul
responsabilităţii îmbracă forma unei
instituţii sociale având atât o evoluţie
proprie cât şi un conţinut corespunzător.
Şi noţiunea de răspundere a
cunoscut o evoluţie similară cu cea a
responsabilităţii.
Această evoluţie este oarecum
specifică întrucât ea nu poate fi plasată în
zonele profunde ale vieţii spirituale ale
omului, ca un dat natural şi valorizat apoi,
ci ea poate fi situată în compartimentul de
viaţă materială a omului întrucât ideea de
răspundere este specifică vieţii normate.
Individul nu acţionează într-un
spaţiu indiferent, pasiv şi neutru, ci într-o
ambianţă socială, în cadrul căreia
parametrii acţiunii sale sunt evaluaţi şi
valorizaţi prin norme sociale.
Şi sfera noţiunii de răspundere este
extinsă, întrucât majoritatea acţiunilor sunt
susceptibile să genereze o formă de
răspundere chiar şi în contextul acelor
relaţii sociale neorganizate sau
nereglementate.
3. Corelaţia responsabilitate
socială - răspundere socială
Răspunderea nu este specifică
exclusiv dreptului, ea poate fi întâlnită în
orice domeniu al vieţii sociale, acolo unde
se transgresează o regulă de conduită.
Sensul frecvent atribuit noţiunii de
răspundere este acela de îndatorire a
autorului transgresării normelor de
conduită de a suporta consecinţele acestei
încălcări şi care poartă totdeauna amprenta
dezaprobării sociale a unei asemenea
conduite.

The premises of the responsibility
are both social and biological, and in terms
of evolution, the phenomenon of
responsibility has the form of a social
institution having both an own evolution as
well as an appropriate content.
The notion of liability also knew a
similar evolution with the evolution of the
responsibility.
This evolution is somewhat specific,
as it may not be located in deep areas of the
human spiritual lives, as a natural given and
then valued, but it may be located in the
compartment of the human material life as
the idea of liability is specific to the normed
life.
The individual does not act in an
indifferent, passive and neutral space, but in
a social ambience, within which the
parameters of their actions are evaluated
and valued by social norms.
Also the sphere of the liability
notion is very large, because most of the
actions are susceptible to generate a form of
liability even in the context of those
unorganised or unregulated social
relationships.
3. The correlation social
responsibility-social liability
The liability is not exclusively
specific to the law, it may be met in any
domain of the social life, where a behavior
rule is transgressed.
The frequent meaning given to the
notion of liability is that of duty for the
author of the transgression of the behavior
norms and to support the consequences of
the violation and which always bear the
footprint of the social disapproval of such a
behavior.
And therefore, if the responsibility

implică un raport între individ şi
colectivitate individul percepându-l din
interior, ca ceva voit interesat15
,
răspunderea comportă, mai ales, un raport
între autoritatea unei colectivităţi şi
individ, şi pe care acesta îl percepe ca pe
ceva exterior.
Responsabilitatea socială reprezintă acea instituţie socială care
cuprinde complexul de atitudini ale omului
în raport cu sistemul de valori,
instituţionalizat de societatea în care
trăieşte, în vederea conservării şi
promovării acelor valori, în scopul
perfecţionării fiinţei umane şi conservării
în comun pe calea menţinerii şi promovării
ordinii sociale şi binelui public.
Responsabilitatea se caracterizează prin
aceea că:
- implică un raport de ordin valoric
între individ şi colectivitate;
- acest raport este perceput ca ceva
interior (are o dimensiune internă);
- are caracter universal şi etern;
- are o sferă mult mai largă decât
răspunderea, raportându-se la activitatea
desfăşurată de individ din proprie
iniţiativă, pe baza alegerii libere a
obiectivelor din mai multe posibile;
- nu exclude răspunderea dar nu se
reduce la ea.
Răspunderea socială este tot o
instituţie socială concretizată, de obicei în
obligaţia autorului de a suporta
consecinţele nerespectării unor reguli de
conduită şi se caracterizează prin aceea că:
- nu poate fi plasată în zonele
profunde ale vieţii spirituale a omului;
- nu este un dat natural şi nu poate fi
valorizată apoi;
- poate fi situată în compartimentul
de viaţă materială a omului, întrucât ideea
de răspundere este specifică vieţii
normate, vizând sistemul normativ al
societăţii la un moment dat;
- nu este specifică exclusiv
dreptului, ea putându-se regăsi în orice
domeniu al vieţii sociale, acolo unde este

Social responsibility represents the
social institution including the complex of
man attitudes in relation with the system of
values, institutionalized by the society
where he lives, in order to preserve and
promote those values, for perfecting the
human being and the joint preservation by
maintaining and promoting the social order
and the public welfare. The responsibility in
characterized in that:
- Implies a value relation between
the individual and the collectivity;
- This relation is perceived as
something interior (it has an internal
dimension);
- It has an universal and eternal
character;
- It has a larger sphere than the
liability, being reported to the activity
conducted by the individual on his own
initiative, based on freely choosing the
objectives from many possible objectives;
- Does not exclude the liability but it
is not limited to it.
Social responsibility is also an social
institution usually concretized in the

consequences of not respecting some
behavior rules and it is characterized by the
following:
- It may not the placed in the
deep areas of the man spiritual life;
- It is not a natural given and
may not be subsequently valued;
- It may be located in the man's
material life behavior, as the idea of liability
is specific to the normated life, aiming the
normative system of the company at a
moment;
- It is not exclusively specific to the
law, it may be found in any domain of the

încălcată o regulă de conduită;
- presupune în esenţă un sistem
cristalizat de valori şi norme;
- presupune îndeplinirea unei
obligaţii sau observarea unor restricţii;
- ţine de ceea ce este organizat şi
vizează comportamente diferite prin norme
sociale;
- comportă un raport între
autoritatea unei colectivităţi şi individ;
- percepe acest raport ca ceva impus
din exterior.
Deşi distincte prin natură şi
conţinut, responsabilitatea şi răspunderea
sunt legate între ele, întrucât ambele
vizează raportul dintre individ şi
colectivitate şi sunt forme de integrare a
individului în societate. Sub aspectul
gradului de integrare există însă diferenţe
în sensul că responsabilitatea implică o
formă superioară de integrare în raport cu
răspunderea care reprezintă o formă
primară, elementară de integrare.
Tocmai în această integrare, care în
final produce progresul individualităţii
umane cu consecinţa firească a angrenării
progresului social, răspunderea şi
responsabilitatea dobândesc caracterul de
valori sociale.
Atât la nivelul evoluţiei istorice, cât
şi la nivelul evoluţiei individuale a omului,
răspunderea se conturează ca realitate
obiectivă înaintea responsabilităţii. Astfel,
Hlavek arată că „în evoluţia filogenetică şi
ontogenetică sentimentul de vinovăţie, de
greşeală şi pedepsele sunt fenomene care
apar mai devreme decât gustul
responsabilităţii, care presupune deja o
personalitate mai evoluată …”16
.
Aşadar, procesul de formare la
nivelul individului uman a atitudinii de
răspundere şi de responsabilitate
corespunde procesului de formare şi
dezvoltare a conştiinţei de sine, prin care
omul reflectă propria sa existenţă în raport
cu ceilalţi şi cu societatea17
.
Răspunderea şi responsabilitatea
sunt două fenomene distincte aflate în
social life, where a behavior rule is broken;
- It essentially supposes a crystalized
system of values and norms;
- It supposes to meet an obligation or
to notice some restrictions;
- It refers to what is organized;
- It includes a relation between the
authority of a collectivity and the
individual;
- It perceives this relation as
something externally imposed.
Although they are different in terms
of nature and content, the responsibility and
the liability and are linked together, as both
aim the relation between the individual and
collectivity, being forms of integrating the
individual in the society. In terms of the
integration level, there are differences
meaning that the responsibility implies a
superior form of integration in relation to
the liability which represents a primary,
elementary form of integration.
Precisely in this integration, which
finally produces the progress of human
individuality with the natural consequence
of engaging the social progress, the liability
and responsibility acquire the character of
social values.
Both at the level of the historical
evolution, as well as at the level of the
human individual level, the liability is
framed as objective reality before the
responsibility. Thus, Hlavek indicates that
"in the phylogenetic and ontogenetic
evolution the feeling of quilt, mistake and
punishments are phenomena
appearing.earlier than the taste of
responsibility, which already supposes a
more evolved personality …”36
.
So, the formation process at the level
of the human individual of the attitude of
liability and responsibility is corresponding
to the process of formatting and developing
the selfconsciousness, by which the man
reflects their own existence in relation to the
others and to the society37
.
The liability and responsibility are
two distinct phenomena in interaction and in

interacţiune şi în influenţă reciprocă,
simultane şi unitare. Când ele nu coincid ca
sens şi ca obiective, apare un conflict. În
acest caz individul este nevoit să aleagă
între acţiunile ce-i sunt prescrise de normă
şi de răspundere şi cele adoptate pe calea
liberei alegeri şi a responsabilităţii18
.
4. Responsabilitatea juridică
Pornind de la conceptul de
responsabilitate socială, responsabilitatea
juridică apare ca o formă a acesteia
constituită din complexul de atitudini ale
omului în raport cu sistemul normativ,
juridic al societăţii în care trăieşte având
drept scop însuşirea, conservarea şi
promovarea acestui sistem şi a valorilor pe
care le exprimă în contextul menţinerii şi
promovării ordinii juridice şi a binelui
public.
Subliniem că responsabilitatea ca
fenomen subiectiv care se obiectivează în
planul acţiunii sociale presupune
interiorizarea de către indivizi a normelor
şi valorilor ca o necesitate conştientizată în
planul reflecţiei individuale. În acest
proces se nasc atitudinile individului în
raport cu valorile afirmate de sistemul
normativ, juridic, întrucât responsabilitatea
este de ordin valoric19
.
Responsabilitatea juridică este
complementară responsabilităţii morale.
Aceasta presupune că aşa-zisele norme
juridice cu caracter tehnic nu sunt de
principiu generatoare de responsabilitate
juridică, lor asociindu-li-se mai repede
noţiunea de răspundere, întrucât nefiind de
ordin valoric, individul nu le apropie
afectiv, responsabilitatea putându-se totuşi
genera ca o consecinţă a răspunderii
individuale în situaţia antrenării acesteia în
cazul încălcării normelor respective.
Arealul de manifestare al
răspunderii şi responsabilităţii juridice este
reprezentat de cadrul normativ, juridic şi
valoric şi, indirect, de cadrul general al
acţiunii sociale.

4. Legal responsibility
Starting from the concept of social
responsibility, the legal responsibility
appears as a form of it consisting of the
complex of man attitudes in relation to the
normative, legal system of the society
where he lives aiming to acquire, preserve
and promote this system and the values
expressed in the context of maintaining and
promoting this system and the public
welfare.
We highlight that the responsibility
as subjective phenomenon objectivized in
the plan of the social action supposes the
internalization by the individuals of norms
and values as a acknowledged necessity in
the plan of the individual reflection. Within
this process the individual's attitudes appear
in relation to the values affirmed by the
normative and legal system, as the
responsibility has a value characteristic39
.
Legal responsibility is
complementary to the moral responsibility.
This supposes that the so-called legal norms
with a technical character are not in
principle generating legal responsibility,
they being associated with the notion of
liability, as not having a value
characteristic, the individual does not
effectively bring them near, the
responsibility being able to be generated as
a consequence of the individual liability in
the situation of its entrainment in case of
violating those norms.
The manifestation area of the legal
liability and responsibility is represented by
the normative, legal and value framework
and indirectly by the general framework of
the social action.

faţă de acest cadru se desprind două nivele
diferite calitativ de integrare a individului
în societate şi anume: un nivel primar, când
individul nu are conştiinţa solidarităţii sale
la comunitatea din care face parte, nivel în
care integrarea este predominantă prin
intermediul normelor şi al răspunderii
juridice şi un nivel secundar, dar superior,
când individul aderă conştient şi voluntar
la normele sistemului, aplicându-le liber şi
căruia îi corespund elemente de integrare
prin intermediul valorilor şi
responsabilităţii juridice.
Cu alte cuvinte, responsabilitatea
juridică reprezintă o formă de integrare a
individului în societate ca urmare a
dezvoltării individualităţii umane la baza
căreia a stat mai ales răspunderea, şi
aceasta pentru că de-a lungul istoriei chiar
în perioadele în care societatea nu dispunea
de sisteme normative, obiceiurile şi
regulile morale constituiau baza
răspunderii.
Atât răspunderea cât şi
responsabilitatea se întemeiază pe o serie
de factori de ordin obiectiv şi subiectiv,
multipli şi diferiţi.
Factorul general şi comun al
răspunderii şi responsabilităţii îl constituie
necesitatea convieţuirii sociale. Însă
factorii de bază pe care se întemeiază cele
două noţiuni sunt exprimaţi de norma
juridică şi de valoarea socială conţinută şi
exprimată de norme. Numai că, dacă
existenţa normei juridice este suficientă în
cazul răspunderii, nu acelaşi lucru se poate
susţine şi în privinţa responsabilităţii
juridice, întrucât, în acest caz, norma
juridică respectivă nu are valoarea unei
obligaţii, ci o altă valoare. Individul poate
înţelege adevăratul conţinut al normei,
poate opta pentru aceasta, ca fiind
concordantă cu interesele şi idealurile sale,
astfel încât norma juridică nu-i mai apare
ca o obligaţie exterioară.
Ca atare, răspunderea juridică este
de ordin normativ, ţine de domeniul
autorităţii publice şi urmăreşte în fapt

efficiency compared to this framework there
are two levels different from the qualitative
point of view in terms of the individual's
integration into the society namely: a
primary level, when the individual has not
the consciousness of the solidarity to the
community they are part of, level where the
integration is predominant by means of
norms and legal responsibility and a
secondary level, but higher, when the
individual joint consciously and voluntarily
to the system norms, applying them freely
and for which there are elements of
integration by means of the values and legal
responsibilities.
In other words, legal responsibility
represents a form of individual integration
in the society as a result of the human
individuality development based on which
there was the liability, and this as
throughout history even during the periods
when the society did not have normative
systems, moral customs and rules were at
the liability basis.
Both the liability as the
responsibility are founded on a series of
objective and subjective multiple and
different factors.
The general and common factor of
the liability and responsibility is represented
by the necessity of social cohabitation. But
the main factors on which the two notions
are based are expressed by the legal norm
and by the social value included and
expressed by norms. Only that, if the
existence of the legal norm is enough for the
liability, it is not the same for the legal
responsibility, as in this situation that legal
norm has not the value of an obligation, but
another value. The individual may
understand the true content of the norm,
may choose it, as being concordant with
their interests and ideals, such that the legal
norm to not appear any more as an external
obligation.
As such, legal liability has a
normative feature, belongs to the domain

respectarea normei de către indivizi
indiferent de poziţia acestora faţă de
prescripţia normei, în timp ce
responsabilitatea juridică este de ordin
valoric, unde individul se raportează la
valorile exprimate şi conţinute de sistemul
normativ juridic al societăţii prin prisma
propriului sistem valoric în raport cu care
îşi manifestă atitudinea.
Aceasta poate fi, la un moment dat,
în acord cu sistemul normativ existent sau
împotriva acestuia, tinzând la înlăturarea şi
la instaurarea unei noi ordini juridice.
Acest lucru se poate întâmpla
întrucât normele nu pot reglementa
exhaustiv comportamentul uman, acestea
nu stabilesc decât acţiunile onerative şi
prohibitive, între acestea găsindu-se şi
acţiunile posibile, nereglementate în
majoritatea lor. Acestea constituie un
spaţiu al libertăţii în care individul
operează reglementări proprii în raport cu
propria sa voinţă.
Dacă pentru răspunderea juridică se
poate stabili ca unic temei conduita ilicită,
nu acelaşi lucru îl putem afirma relativ la
responsabilitate întrucât aceasta poate
exista înaintea săvârşirii unui fapt ilicit,
poate surveni în momentul declanşării
acţiunii, pe parcursul derulării ei sau ca o
consecinţă a răspunderii juridice după
finalizarea acţiunii respective.
Condiţia indispensabilă pentru
fundamentarea responsabilităţii a atitudinii
comportamentale şi acţionale a individului
este libertatea de decizie a acestuia care
este simultan atât rezultat cât şi premisă a
acţiunii. Ea se poate manifesta ca libertate
de alegere, atât atunci când este în acord cu
sistemul normativ-juridic existent, cât şi
atunci când este contrară.
Aşa cum afirma Mihai Florea20
,
decizia implică nu numai informaţie şi
cunoaştere, deliberare raţională pe bază de
calcul riguros, ci şi perspicacitate şi intuiţie
iar luarea deciziei nu este numai ştiinţă, ci
şi artă; nu numai calculul riguros, ci şi
prognoza statistică, nu numai siguranţă ci

system or against it, tending to remove it
and to establish a new legal order.
This thing can happen because the
norms can not regulate in a exhaustive way
the human behavior, they can establish only
onerative and prohibitive actions, among
them also being the possible actions, not
regulated in their majority. This is a space
of freedom where the individual operates
their own regulations in relation to their
own will.
If for the legal liability it can be
established as unique base the illicit
behavior, it is not the same for the
responsibility as it may exist before
committing an illicit action, it may occur
during the action starting, during its
conduction or as a consequence of the legal
liability after the completion of that action.
The indispensable condition for
grounding of responsibility of behavioral
and action attitude of the individual is his
freedom of decision which is
simultaneously both the result as well as the
premise of the action. It may be manifested
as a freedom of choice, both when it is in
accordance with the existing normative-
legal system, as well as when it is contrary.
As Mihai Florea40
states, the
decision implies not only information and
knowledge, rational deliberation based on a
strict calculation, but also perspicacity and
intuition and making decisions is not only
science, but also art; not only strict
calculation, but also statistical forecast, not
only safety, but also risk; not only courage,

şi risc; nu numai curaj, ci şi cumpătare, iar
agentul are nu numai perspectiva gloriei, ci
şi pe cea a sacrificiului, el este nu numai
liber, ci şi responsabil.
5. Succinte concluzii
Responsabilitatea nu se distribuie
egal între toţi membrii societăţii, ea putând
chiar lipsi la o parte din ei.
Responsabilitatea este de ordin valoric. Pe
cale de consecinţă criteriul responsabilităţii
este reprezentat de valoare.
Relaţiile sociale ce intră în sfera de
reglementare juridică exprimă şi acoperă
valori sociale dintre cele mai diverse.
Criteriile responsabilităţii juridice
sunt reprezentate de valorile sociale
exprimate de sistemul normativ-juridic prin
norme juridice, precum şi de cele care nu
au căzut sub incidenţa normei, dar care
sunt de natură a concretiza o cerinţă
socială, care la rândul ei reclamă o
reglementare juridică.
Responsabilitatea vizează
valorificarea posibilităţilor de acţiune ce
depăşesc sfera celor reglementate pe calea
normelor şi a răspunderii, dar care ţin de
perspectiva aceloraşi valori şi idealuri.
În plan valoric, demersul este
reprezentat de lupta binelui împotriva
„binelui” conservator, retrograd, iar uneori
chiar împotriva răului.
Ca atare, responsabilitatea joacă un
rol deosebit în evoluţia societăţii,
promovând deopotrivă siguranţa, justiţia şi
progresul social ca valori juridice, iar
răspunderea acţionează mai limitat în
sensul menţinerii şi promovării siguranţei
şi stabilităţii juridice.

5. Short conclusions
Responsibility is not equally
distributed among all the member of the
society, even existing the possibility of
missing to a part of them. The responsibility
has a value feature. Consequently, the
criterion of the responsibility is represented
by the value.
Social relations included in the
sphere of the expressed legal regulation
covers very different social values.
The criteria of legal responsibilities
are represented by the social values
expressed by the normative and legal
system, by legal norms, as well as by those
which were not under the norm incidence,
but which may concretize a social request,
which, it its turn claims a legal regulations.
The responsibility aims the valuation
of the action possibility exceeding the
sphere of those regulated by norms and
liability, but which belong to the
perspective of the same values and ideals.
In the value plan, the approach is
represented by the fight of good against the
conservator, retrograde "good" and
sometimes even against the bad.
As such, the responsibility plays a
particular role in the evolution of the
society, promoting in the same time the
safety, justice and social progress as legal
values, the liability acts more limitedly in
the sense of maintaining and promoting the
safety and legal stability.
