    CAP. I Dispoziii generale

    ART. 1 Evaluarea performanelor profesionale individuale anuale ipromovarea personalului contractual din cadrul inisterului Pu!licse realizeaz" potrivit legii i prezentului regulament.

    ART. # $1% Prezentul regulament sta!ilete cadrul general pentrurealizarea urm"toarelor o!iective& a% asigurarea concordanei dintre cerinele i standardelepostului' descrise (n fia postului' i calit"ile anga)atului&profesionale' aptitudinale i atitudinale* !% asigurarea unui sistem motivaional' care s" determinecreterea performanelor profesionale individuale' prin promovarea(n grade ori trepte profesionale imediat superioare. $#% Pentru atingerea acestor o!iective prezentul regulamentprevede& a% evaluarea posturilor (n funcie de caracteristicile

    descriptive privind e+igenele i performanele pe care acestea leimpun anga)ailor* !% evaluarea performanelor profesionale ale anga)ailor (nraport cu cerinele posturilor.

    CAP. II Evaluarea performanelor profesionale individuale alepersonalului contractual

    ART. , Evaluarea performanelor profesionale individuale are ca scopaprecierea o!iectiv" a activit"ii personalului' prin comparareagradului de (ndeplinire a o!iectivelor i criteriilor de evaluare

    sta!ilite pentru perioada respectiv" cu rezultatele o!inute (n modefectiv. ART. - Evaluarea performanelor profesionale individuale tre!uie f"cut"cu pro!itate' deontologie profesional" i o!iectivitate. ART. Procedura evalu"rii se realizeaz" (n urm"toarele etape& a% completarea fiei de evaluare de c"tre evaluator* !% interviul* c% contrasemnarea fiei de evaluare. ART. / Are calitatea de evaluator& a% persoana aflat" (n funcia de conducere care coordoneaz"compartimentul (n cadrul c"ruia (i desf"oar" activitatea

    salariatul aflat (ntr0o funcie de e+ecuie sau care coordoneaz"activitatea acestuia* !% persoana aflat" (n funcia de conducere ieraric superioar"'potrivit structurii organizatorice a parcetului' pentru salariatulaflat (ntr0o funcie de conducere. ART. 2 $1% 3unt supui evalu"rii anuale salariaii care au desf"uratactivitate cel puin / luni (n cursul perioadei evaluate. $#% 3unt e+ceptai de la evaluarea anual" salariaii care ocup"funcia de de!utant i care sunt evaluai la sf4ritul perioadei dede!ut. ART. 5 $1% Activitatea profesional" se apreciaz" anual' prin evaluareaperformanelor profesionale individuale. $#% Perioada evaluat" este cuprins" (ntre 1 ianuarie i ,1decem!rie din anul pentru care se face evaluarea' dar nu mai puinde / luni de activitate pe funcia respectiv". $,% Evaluarea se finalizeaz" cel t4rziu la data de ,1 martie aanului urm"tor perioadei evaluate. ART. 6 7n mod e+cepional' evaluarea performanelor profesionaleindividuale ale personalului contractual se face i (n cursulperioadei evaluate' (n urm"toarele cazuri& a% atunci c4nd pe parcursul perioadei evaluate contractulindividual de munc" al salariatului evaluat (nceteaz"' cu e+cepiapension"rii' sau se modific"' (n condiiile legii. 7n acest caz'salariatul va fi evaluat pentru perioada de p4n" la (ncetarea saumodificarea raporturilor de munc"* !% atunci c4nd pe parcursul perioadei evaluate raportul de munc"al evaluatorului (nceteaz"' se suspend" sau se modific"' (ncondiiile legii. 7n acest caz' evaluatorul are o!ligaia ca'(nainte de (ncetarea' suspendarea sau modificarea raporturilor demunc" ori' dup" caz' (ntr0o perioad" de cel mult 1 zilecalendaristice de la (ncetarea ori modificarea raporturilor demunc"' s" realizeze evaluarea performanelor profesionaleindividuale ale salariailor din su!ordine. Calificativul acordat seva lua (n considerare la evaluarea anual" a performanelorprofesionale individuale ale acestora* c% atunci c4nd pe parcursul perioadei evaluate salariatuldo!4ndete o diplom" de studii de nivel superior i urmeaz" s" fiepromovat' (n condiiile legii' (ntr0o funcie corespunz"toarestudiilor a!solvite. ART. 18 $1% Criteriile generale de evaluare a performanelorprofesionale individuale ale personalului contractual sunt prev"zutela art. lit. c% din 9egea0cadru nr. #5-:#818 privind salarizareaunitar" a personalului pl"tit din fonduri pu!lice' cu modific"rileulterioare. $#% De asemenea' evaluarea se realizeaz" i (n !aza urm"toarelorcriterii specifice de evaluare pentru funciile de conducere'respectiv pentru funciile de e+ecuie& a% criterii specifice de evaluare pentru funciile de conducere& 0 capacitatea de a conduce*

    0 capacitatea de coordonare* 0 capacitatea de control* 0 competena decizional"*

    0 capacitatea de a delega* 0 capacitatea de a dezvolta a!ilit"ile personalului* 0 a!ilit"i de mediere i negociere* 0 capacitatea de a rezolva eficient pro!lemele* 0 capacitatea de asumare a responsa!ilit"ilor* 0 capacitatea de autoperfecionare i de valorificare ae+perienei do!4ndite* 0 creativitate i spirit de iniiativ"* 0 capacitatea de planificare i organizare a timpului de lucru* 0 capacitatea de gestionare eficient" a resurselor alocate* 0 integritatea moral" i etic" profesional"* !% criterii specifice de evaluare pentru funciile de e+ecuie& 0 capacitatea de a rezolva eficient pro!lemele* 0 capacitatea de asumare a responsa!ilit"ii* 0 capacitatea de autoperfecionare i de valorificare ae+perienei do!4ndite* 0 creativitate i spirit de iniiativ"* 0 capacitatea de planificare i organizare a timpului de lucru* 0 capacitatea de a lucra independent* 0 capacitatea de a lucra (n ecip"* 0 capacitatea de gestionare eficient" a resurselor alocate* 0 integritatea moral" i etic" profesional". $,% 7n funcie de activit"ile efectiv desf"urate de c"tresalariat i de specificul domeniului de activitate' evaluatorulpoate sta!ili i alte criterii de evaluare care' astfel sta!ilite'se aduc la cunotina salariatului evaluat la (nceputul perioadeievaluate. $-% 3alariaii care e+ercit"' cu caracter temporar' o funcie deconducere vor fi evaluai pentru perioada e+ercit"rii temporare pe!aza criteriilor de evaluare sta!ilite pentru funcia de conducererespectiv". ART. 11 Persoanele care au calitatea de evaluator' potrivit art. /'completeaz" fiele de evaluare' al c"ror model este prev"zut (nane+a nr. 1a' respectiv nr. 1!' dup" cum urmeaz"& a% sta!ilesc gradul de (ndeplinire a o!iectivelor' prinraportare la atri!uiile sta!ilite prin fia postului' (ntocmit"conform modelului prev"zut (n ane+a nr. #* !% sta!ilesc calificativul final de evaluare a performanelorprofesionale individuale* c% consemneaz"' dup" caz' rezultatele deose!ite alesalariatului' dificult"ile o!iective (nt4mpinate de acesta (nperioada evaluat" i orice alte o!servaii pe care le consider"relevante* d% sta!ilesc o!iectivele i criteriile specifice de evaluarepentru urm"toarea perioad" de evaluare* e% sta!ilesc eventualele necesit"i de formare profesional"pentru anul urm"tor perioadei evaluate. ART. 1# $1% Interviul' ca etap" a procesului de evaluare' reprezint" unscim! de informaii care are loc (ntre evaluator i persoanaevaluat"' (n cadrul c"ruia& a% se aduc la cunotina persoanei evaluate not"rile i

    consemn"rile f"cute de evaluator (n fia de evaluare* !% se semneaz" i se dateaz" fia de evaluare de c"tre evaluatori de c"tre persoana evaluat".

    $#% 7n cazul (n care (ntre persoana evaluat" i evaluator e+ist"diferene de opinie asupra not"rilor i consemn"rilor f"cute' (nfia de evaluare se va consemna punctul de vedere al persoaneievaluate* evaluatorul poate modifica fia de evaluare. ART. 1, $1% Pentru sta!ilirea calificativului' evaluatorul va proceda lanotarea o!iectivelor i criteriilor de evaluare' prin acordareapentru fiecare o!iectiv i criteriu a unei note de la 1 la ' notae+prim4nd aprecierea gradului de (ndeplinire. $#% Pentru a o!ine nota final" a evaluatorului se face mediaaritmetic" a notelor o!inute ca urmare a aprecierii o!iectivelor icriteriilor' rezultate din media aritmetic" a notelor acordatepentru fiecare o!iectiv sau criteriu' dup" caz. $,% 3emnificaia notelor prev"zute la alin. $1% este urm"toarea&nota 1 0 nivel minim i nota 0 nivel ma+im. ART. 1- Calificativul final al evalu"rii se sta!ilete pe !aza noteifinale' dup" cum urmeaz"& a% (ntre 1'88 0 #'88 0 nesatisf"c"tor* !% (ntre #'81 0 ,'8 0 satisf"c"tor* c% (ntre ,'1 0 -'8 0 !un* d% (ntre -'1 0 '88 0 foarte !un. ART. 1 $1% Dup" finalizarea etapelor procedurii de evaluare menionatela art. lit. a% i !%' fia de evaluare se (nainteaz" persoanei'care contrasemneaz". $#% 7n sensul prezentului regulament' are competena de acontrasemna salariatul aflat (n funcia superioar" evaluatorului'potrivit structurii organizatorice a parcetului. $,% 7n situaia (n care calitatea de evaluator o areconduc"torul parcetului' fia de evaluare nu se contrasemneaz". ART. 1/ $1% ;ia de evaluare poate fi modificat" conform decizieipersoanei care contrasemneaz"' (n urm"toarele cazuri& a% aprecierile consemnate nu corespund realit"ii* !% (ntre evaluator i persoana evaluat" e+ist" diferene deopinie care nu au putut fi soluionate de comun acord. $#% ;ia de evaluare modificat" (n condiiile prev"zute la alin.$1% se aduce la cunotina salariatului evaluat. ART. 12 $1% 3alariaii nemulumii de rezultatul evalu"rii pot formulacontestaie la conduc"torul parcetului. $#% Contestaia se formuleaz" (n termen de zile calendaristicede la luarea la cunotin" de c"tre salariatul evaluat acalificativului acordat i se soluioneaz" (n termen de 1 zilecalendaristice de la data e+pir"rii termenului de depunere acontestaiei de c"tre conduc"torul parcetului. $,% Rezultatul contestaiei se comunic" salariatului (n termende zile calendaristice de la soluionarea contestaiei. $-% 3alariatul nemulumit de modul de soluionare a contestaieiformulate potrivit alin. $1% se poate adresa instanei competente'(n condiiile legii.

    Promovarea (n grade sau trepte profesionale imediat superioare apersonalului contractual

    ART. 15 Prin promovare se asigur" evoluia (n carier" a personaluluicontractual' prin trecerea (ntr0un grad superior sau (ntr0o treapt"profesional" superioar". ART. 16

    Promovarea persoanelor (ncadrate cu contract individual de munc"(n grade sau trepte profesionale se face' de regul"' pe un postvacant ori temporar vacant' iar (n situaia (n care nu e+ist" unasemenea post se face prin transformarea postului din statul defuncii (n care acestea sunt (ncadrate (n unul de nivel imediatsuperior. ART. #8 7n vederea aprecierii posi!ilit"ii i oportunit"ii promov"riipersonalului (n grade sau trepte profesionale' desf"ur"riie+amenului i sta!ilirii datei acestuia'

    c% alte date necesare desf"ur"rii e+amenului. $,% 7n condiiile modific"rii unor aspecte referitoare laorganizarea sau desf"urarea e+amenului se face pu!licitateamodific"rii respective (n condiiile prezentului articol. ART. #- $1% 7n vederea particip"rii la e+amen' (n termen de 18 zile dela data afi"rii anunului' candidaii depun cereri de promovare (ngrade sau trepte profesionale imediat superioare la conduc"torulparcetului unde acetia (i desf"oar" activitatea. $#% Cererile vor fi (naintate la parcetul de pe l4ng" curtea deapel (n ma+imum zile de la e+pirarea termenului prev"zut la alin.$1%. ART. # $1% Comisia de e+aminare efectueaz" selecia dosarelor de e+amen(n termen de , zile lucr"toare de la data primirii dosarelor. $#% Rezultatele seleciei dosarelor de (nscriere se afieaz" dec"tre secretarul comisiei de e+aminare' cu meniunea >admis> sau>respins>' (nsoite de motivul respingerii dosarului' la sediulparcetului care organizeaz" e+amenul' precum i la sediileparcetelor unde candidaii (i desf"oar" activitatea. $,% Candidaii ale c"ror cereri de (nscriere la e+amen au fostrespinse pot face contestaie (n termen de -5 de ore de la afiarearezultatelor verific"rii (ndeplinirii condiiilor pentruparticiparea la e+amen. $-% Contestaiile depuse de candidai cu privire la rezultatulverific"rii (ndeplinirii condiiilor pentru participarea la e+amense soluioneaz" (n termen de dou" zile lucr"toare. ART. #/ $1% Cu cel puin 1 zile lucr"toare (nainte de data desf"ur"riie+amenului' conduc"torul parcetului care organizeaz" e+amenulnumete' prin decizie' comisia de e+aminare' comisia de soluionarea contestaiilor' precum i secretariatul e+amenului. $#% Comisia de e+aminare' precum i comisia de soluionare acontestaiilor sunt formate din c4te , mem!ri' dup" cum urmeaz"& a% un mem!ru din cadrul anga)atorului* !% un mem!ru de la nivelul ordonatorului de credite teriar* c% un mem!ru de sindicat sau' dup" caz' un reprezentant alsalariailor. $,% em!rii tre!uie s" ai!" e+periena i cunotinele necesare(n domeniul postului (n care se face promovarea* pot fi desemnatepersoane din cadrul departamentului economico0financiar iadministrativ sau consilierul )uridic. $-% Preedintele comisiei de e+aminare' respectiv al comisiei desoluionare a contestaiilor se desemneaz" din r4ndul mem!riloracestora' prin actul administrativ de constituire a comisiilor. $% 3ecretariatul comisiei de e+aminare i secretariatulcomisiei de soluionare a contestaiilor se asigur" de c"tre opersoan" din cadrul compartimentului de resurse umane alanga)atorului. $/% Persoanele desemnate (n comisiile de e+aminare sau desoluionare a contestaiilor tre!uie s" dein" o funcie' inclusivfuncie pu!lic"' cel puin egal" sau ecivalent" cu funciacontractual" pentru care se organizeaz" e+amenul de promovare i s"

    nu se afle (n cazurile de incompati!ilitate sau conflict deinterese. ART. #2

    $1% ?u poate fi desemnat" (n calitatea de mem!ru (n comisia dee+aminare sau (n comisia de soluionare a contestaiilor persoanacare a fost sancionat" disciplinar' iar sanciunea aplicat" nu afost radiat"' conform legii. $#% ?u poate fi desemnat" (n calitate de mem!ru (n comisia dee+aminare sau (n comisia de soluionare a contestaiilor persoanacare se afl" (n una dintre urm"toarele situaii& a% are relaii cu caracter patrimonial cu oricare dintrecandidai sau interesele sale patrimoniale ori ale soului sausoiei pot afecta imparialitatea i o!iectivitatea evalu"rii* !% este so' soie' rud" sau afin p4n" la gradul al I@0leainclusiv cu oricare dintre candidai ori cu un alt mem!ru alcomisiei de e+aminare sau al comisiei de soluionare acontestaiilor. $,% Calitatea de mem!ru (n comisia de e+aminare esteincompati!il" cu calitatea de mem!ru (n comisia de soluionare acontestaiilor. ART. #5 $1% 3ituaiile de incompati!ilitate sau conflict de interese potfi sesizate de persoana (n cauz"' de oricare dintre candidai' deanga)ator sau de orice alt" persoan" interesat"' (n orice moment alorganiz"rii i desf"ur"rii e+amenului. $#% em!rii comisiei de e+aminare i comisiei de soluionare acontestaiilor au o!ligaia s" informeze' (n scris' de (ndat"'conduc"torul parcetului despre apariia oric"rei situaii deincompati!ilitate sau conflict de interese i s" se a!in" de laparticiparea ori de la luarea vreunei decizii cu privire la e+amen. $,% 7n cazul constat"rii e+istenei uneia dintre acestesituaii' actul de numire a comisiei se modific" (n modcorespunz"tor' (n termen de cel mult dou" zile lucr"toare de la dataconstat"rii' prin (nlocuirea mem!rului aflat (n situaia respectiv". ART. #6 Comisia de e+aminare are urm"toarele atri!uii principale& a% selecteaz" dosarele candidailor* !% sta!ilete tipul pro!elor de e+amen& pro!a scris" sau pro!apractic"' dup" caz' i interviul* c% sta!ilete su!iectele pentru pro!a scris"* d% sta!ilete planul pro!ei practice i asigur" condiiilepentru desf"urarea acesteia* e% sta!ilete planul interviului i realizeaz" interviul* f% noteaz" pentru fiecare candidat pro!a scris" sau pro!apractic" i interviul* g% transmite secretarului comisiei rezultatele e+amenului pentrua fi comunicate candidailor* % semneaz" procesele0ver!ale (ntocmite de secretarul comisieidup" fiecare etap" de e+amen' precum i raportul final ale+amenului. ART. ,8 $1% Comisia de e+aminare evalueaz" performanele profesionaleindividuale pe !aza urm"toarelor criterii& a% cunotine teoretice necesare funciei evaluate* !% comportamentul (n situaii de criz"* c% a!ilit"i de comunicare*

    ateste preg"tirea profesional" i gradul de acumulare a e+perieneiprofesionale (n domeniul respectiv. Pro!a scris" poate fi susinut"i su! forma unui test0gril". $,% Criteriile prev"zute la alin. $1% lit. !%0d% se evalueaz" (ncadrul interviului. $-% Comisia de e+aminare poate sta!ili i alte criterii deevaluare specifice care vor fi evaluate (n cadrul interviului' cumar fi& a% comple+itate' iniiativ"' creativitate i diversitate aactivit"ilor* !% )udecata i impactul deciziilor* c% influen"' coordonare i supervizare* d% asumarea responsa!ilit"ii* e% motivaia candidatului. ART. ,1 Comisia de soluionare a contestaiilor are urm"toareleatri!uii principale& a% soluioneaz" contestaiile depuse de candidai cu privire laselecia dosarelor i cu privire la notarea pro!ei scrise' pro!eipractice i a interviului* !% transmite secretarului comisiei rezultatele contestaiilorpentru a fi comunicate candidailor. ART. ,# 3ecretarul comisiei de e+aminare i comisiei de soluionare acontestaiilor are urm"toarele atri!uii principale& a% primete dosarele de e+amen ale candidailor' respectivcontestaiile' dup" caz* !% convoac" mem!rii comisiei de e+aminare' respectiv mem!riicomisiei de soluionare a contestaiilor' la solicitareapreedintelui comisiei* c% (ntocmete' redacteaz" i semneaz" al"turi de comisia dee+aminare' respectiv de comisia de soluionare a contestaiilor(ntreaga documentaie privind activitatea specific" a acesteia'inclusiv raportul final al e+amenului' care va fi semnat de c"tretoi mem!rii comisiei* d% asigur" transmiterea:afiarea rezultatelor o!inute decandidai la pro!ele e+amenului' respectiv a rezultateloreventualelor contestaii* e% (ndeplinete orice sarcini specifice necesare pentru !unadesf"urare a e+amenului. ART. ,, $1% 7n ziua desf"ur"rii e+amenului' comisia de e+aminareela!oreaz" su!iectele i !aremele de corectare pentru pro!a scris"'pe !aza tematicii apro!ate. $#% 9ocul desf"ur"rii e+amenului' timpul afectat ela!or"riilucr"rii' precum i modalitatea de securizare a lucr"rilor suntsta!ilite de comisia de e+aminare. $,% ;rauda dovedit" atrage eliminarea candidatului din e+amen.7n acest caz' lucrarea se anuleaz" cu meniunea >fraud"> i se(nceie un proces0ver!al (n acest sens' iar candidatul va fideclarat respins. $-% 9a sf4ritul susinerii pro!ei scrise se afieaz" !aremul decorectare.

    ART. ,- $1% 7n cadrul e+amenului de promovare fiecare dintre cele dou"pro!e' respectiv pro!a scris" sau pro!a practic"' dup" caz' i

    interviul' vor fi notate cu un puncta) ma+im de 188 de puncte. $#% em!rii comisiei de e+aminare acord" individual puncta)epentru fiecare dintre cele dou" pro!e menionate la alin. $1%'consemnate (n !orderoul de notare. $,% Puncta)ul final al fiec"reia dintre cele dou" pro!e secalculeaz" ca medie aritmetic" a puncta)elor prev"zute la alin. $#%. ART. , $1% Puncta)ul e+amenului de promovare se calculeaz" ca mediearitmetic" a puncta)elor finale o!inute la fiecare dintre cele dou"pro!e' pro!a scris" sau pro!a practic"' dup" caz' i interviul. $#% Puncta)ul minim de promovare este de 8 de puncte.
