Raportul de monitorizarea a stadiului pregãtirii României pentru statutul de membru UE al Comisiei Europene, publicat în luna septembrie, a evidenþiat progresele obþinute în domeniul concu-renþei atât în ceea ce priveºte aplicarea legislaþiei, cât ºi în activitatea de promovare a regulilor specifice domeniilor concurenþei ºi ajutorului de stat.

Evaluarea pozitivã a domeniului concurenþei în Raportul de monitorizare a fost rezultatul eforturilor depuse atât de autoritatea românã de concurenþã, autoritãþile guvernamentale române, cât ºi de sprijinul direct acordat de cãtre Comisia Europenã concretizat în asistenþa tehnicã permanentã.

Consiliul Concurenþei, în calitatea sa de integrator al Capitolului 6

de negociere - Politica în domeniul concurenþei, a acþionat cu profesionalism pentru îndeplinirea obiectivelor prioritare care au vizat: armonizarea legislaþiei româneºti cu practicile internaþionale ºi europene, întãrirea capacitãþii administrative, îmbunãtãþirea modului de implementare a legislaþiei, întãrirea controlului ajutoarelor de stat acordate în România. Un alt obiectiv prioritar a fost dezvoltarea dialogului cu autoritãþile române, care au înþeles necesitatea introducerii în practica concurenþialã româneascã a mecanismelor unei economii de piaþã funcþionalã.

„Concurenþa este unul dintre capitolele considerate în totalitate pe drumul cel bun (on track) ºi nu mai ridicã probleme sub niciun aspect datoritã progreselor constante. Acest lucru constituie cea mai bunã dovadã a credibilitãþii pe care a cãpãtat-o autoritatea de concurenþã din România. Deºi au existat dubii în ceea ce priveºte capacitatea României de a atinge standarde europene în domeniul concurenþei, acestea au fost spulberate ºi nu s-a pus problema activãrii clauzei de salvgardare. Fãrã o abordare coerentã, armonizatã, la nivelul societãþii româneºti, problemele complexe de concurenþã ar fi fost dificil de rezolvat. Unul din elementele pozitive, poate cel mai important, este cã s-a înþeles nevoia respectãrii regulilor de concurenþã ºi a celor vizând acordarea ajutorului de stat fãrã a încãlca principiile europene”

The Monitoring report on the state of preparedness for EU membership of Romania, issued by the European Commission and published in September, highlighted the progresses achieved in the competition field, as regards the legislation enforcement, as well as the activity of promoting the rules specific to the field of competition and State aid.

The positive evaluation of the competition field was the result of the efforts of the Romanian competition authority, of the Romanian Governmental authorities, as well as due to the direct support of the European Commission, which was concretized in the permanent technical assistance.

The Competition Council, as integrator of the negotiation Chapter 6

– Competition policy, proceeded with professionalism towards fulfilling the priority objectives envisaging: the harmonization of the Romanian legislation with the international and European practices, strengthening the administrative capacity, improving the legislation enforcement, strengthening the control of the State aids granted in Romania. Another priority objective was the development of the dialogue with the Romanian authorities, which understood the necessity of introducing the mechanisms of a functioning market economy into the Romanian competition practice.

“The Competition is one of the chapters totally considered to be on track. It does not present problems anymore, from any point of view, due to the constant progresses. This represents the best confirmation of the credibility achieved by the Romanian competition authority. Although there were doubts as regards the Romanian capacity to attain the European standards in the field of competition, they were dissipated and the issue of activating the safeguard clause was not put on the agenda. Without a coherent harmonized approach at the level of the Romanian society, the complex competition issues would have been difficult to be resolved. One of the positive elements, maybe the most important, is the fact that the need of observing the competition rules and those envisaging the State aid granting without infringing the European principle was understood.”

Un reprezentant al Consiliului Concurenþei a participat sãptãmânal la reuniunea de coordonare a afacerilor europene organizatã de cãtre Ministerul Afacerilor Externe ºi Ministerul Integrãrii Europene.

•20 septembrie - participare la prima Reuniune a Grupului

Interinstituþional pentru Promovarea ºi Susþinerea Surselor Regenerabile de Energie, Eficienþã Economicã ºi Biocombustibili, la sediul Ministerului Integrãrii Europene;

•20 septembrie - participare la reuniunea organizatã de

Ministerul Afacerilor Externe cu reprezentanþi ai ministerelor în scopul discutãrii detaliilor tehnice ale funcþionãrii reþelei EXTRANET.ro de transmitere a informaþiilor UE;În conformitate cu prevederile Acordului de securitate încheiat între România ºi UE, România s-a angajat sã asigure protecþia informaþiilor UE în conformitate cu cerinþele conþinute în standardele de securitate ale UE.

În luna septembrie au continuat raportãrile Enforcement record pe probleme de concurenþã ºi ajutor de stat cãtre Ministerul Integrãrii Europene ºi Comisia Europeanã.

Preºedintele Consiliului Concurenþei, domnul Mihai Berinde, a

participat la întâlnirea Reþelei Europene a Concurenþei (European

Competition Network – ECN), care a reunit ºefii autoritãþilor de concurenþã din statele membre ºi pe cei ai autoritãþilor de concurenþã

din România ºi Bulgaria, 29 septembrie, Bruxelles.

Reþeaua Europeanã a Concurenþei, creatã prin Regulamentul CE nr.1/2003, instituie mecanismul de cooperare între autoritãþile de concurenþã ale statelor membre.

În cadrul Reþelei au loc dezbateri pe marginea problematicii de concurenþã la nivel european, se realizeazã studii ºi se propun acþiuni ca punct de plecare în dezvoltarea ºi perfecþionarea politicilor comunitare în domeniu.

INTERNATIONAL RELATIONS

A representative of the Competition Council attended weekly the coordination reunion of the European affairs organized by the Ministry of Foreign Affairs and the Ministry of European Integration.

•September, 20 - attendance at the first Reunion of the Inter-

institutional Group for Promoting and Sustaining the Renewable Sources of Energy, Economic Efficiency and Biofuels, at the headquarters of the Ministry of European Integration;

•September, 20 - attendance at the reunion organized by the

Ministry of Foreign Affairs with the representatives of the ministries in order to debate the technical details of the functioning of the network EXTRANET.ro designed for transmitting of the EU information.According to the provisions of the Security Agreement, concluded between Romania and EU, Romania took the commitment to ensure the protection of the EU information in line with the requirements of the EU security standards.

During September continued the reporting to the Ministry of European Integration and to the European Commission of the Enforcement records on competition and State aid.

The President of the Competition Council, Mr. Mihai Berinde, attended

the meeting of the European Competition Network (ECN), which reunited the chiefs of the competition authorities from the Member

States and of the Romanian and Bulgarian authorities, September, 29, Bruxelles.

The European Competition Network, created through EC Regulation no.1/2003, institutes the cooperation mechanism between the competition authorities of the Member States.

Within the Network are carried out debates on the competition issue from the European level point of view, studies are being undertaken and certain actions are being proposed as a start point in order to develop and improve the Community policy in the field.

Dintre temele incluse pe agenda reuniunii amintim: - politica de clemenþã;- aranjamentele directe;- revizuirea aplicãrii articolului 82;- revizuirea regulilor în domeniul maritim;- analizele sectoriale;- implementarea regulilor în domeniul serviciilor profesionale.

Îndeplinirea angajamentelor asumate în vederea integrãrii europene presupune consolidarea capacitãþii administrative pentru aplicarea legislaþiei în domeniu conform standardelor europene. Motivat de realizarea acestui deziderat, Consiliul Concurenþei acordã o

atenþie deosebitã perfecþionãrii profesionale a personalului de

specialitate, atât prin seminarii interactive intra ºi interde-partamentale, cât ºi prin participãri ale acestuia la acþiuni interne ºi internaþionale pe teme de interes privind concurenþa ºi ajutorul de stat.

În luna septembrie, experþi ai Consiliului Concurenþei au participat la:

•Reuniunea Sub-grupului ECN privind serviciile profesionale,

6 septembrie, Bruxelles;

•a 19-a Reuniune Plenarã ECN, în calitate de observator,

12 septembrie, Bruxelles.

La reuniune au participat, pe lângã experþi din cadrul DG Concurenþã, delegaþii din toate cele 25 þãri membre ale Uniunii Europene, precum ºi din România ºi Bulgaria, þãri cu statut de observator. Din partea României, la ºedinþa de lucru ECN a participat, pe lângã reprezentanþii Consiliului Concurenþei, ºi un reprezentant al Misiunii României pe lângã Uniunea Europeanã. Reuniunea a fost axatã pe mai multe subiecte, printre care s-au numãrat: problematica schimbului de informaþii atât în interiorul reþelei cât ºi cu þãrile AELS (Asociatia Europeanã a Liberului Schimb), politica de clemenþã, înþelegerile directe, anchetele sectoriale.

•Audierea publicã organizatã în contextul adoptãrii de cãtre

Comisia Europeanã, la începutul anului viitor, a Strategiei revizuite

a Uniunii Europene în domeniul energiei, 22 septembrie, Bruxelles.

Întâlnirea a reunit reprezentanþi ai celor mai importante instituþii ºi organizaþii europene, alãturi de reprezentanþi ai actorilor cheie din domeniul energiei.

Of the points on the agenda, we mention:- the leniency policy;- the direct arrangements;- the review of enforcing art.82;- the review of the maritime rules;- the sectoral analyses;- the implementation of the rules in the field of professional services.

The fulfillment of the assumed commitments connected to the EU accession implies the consolidation of the administrative capacity in order to enforce the specific legislation in line with the European standards. Motivated by this objective, the Competition Council grants a special

attention to the professional improvement of its specialty

personnel by organizing interactive intra and interdepartmental seminars, as well as by attending internal and international events on competition and State aid.

During September, the experts of the Competition Council attended the following:

•Reunion of the ECN Subgroup on the professional services,

September, 6, Bruxelles;th•The 19 ECN Plenary Reunion, as observer, Bruxelles,

September, 12.

At the reunion attended, alongside the experts within the DG Competition, delegations from all 25 Member States of the European Union, as well as from Romania and Bulgaria, countries having observer status. On behalf of Romania, at the ECN working meeting attended, alongside the representatives of the Competition Council, a representative of the Romania's Mission at the European Union. The reunion focused on several subjects among which were: the information exchange within the network, as well as with the EFTA (European Free Trade Association) countries, the leniency policy, direct agreements, sectoral analyses.

•Public hearing organized in the context of adopting by the

European Commission at the beginning of the next year, of the Reviewed strategy of the European Union in the field of energy,

September, 22, Bruxelles.

The meeting reunited the representatives of the most important European institutions, along with the representatives of the key actors in the field of energy.

În cadrul audierii au fost dezbãtute douã teme principale:- Mixul energetic al Uniunii Europene în contextul necesitãþii atingerii a trei obiective: creºtere durabilã, competitivitate ºi securitate în aprovizionare;- Piaþa internã europeanã de energie, competitivã ºi sigurã, în beneficiul cetãþenilor ºi industriei din Uniunea Europeanã.

•Participarea la întâlnirea anualã a Grupului de lucru ECN privind

Economistul ªef în domeniul concurenþei, organizatã de cãtre DG

Concurenþã a Comisiei Europene, 21 - 23 septembrie Stockholm.

Agenda de lucru a întâlnirii a cuprins urmãtoarele teme:

- Despãgubirile private ºi beneficiile publice în cazurile de încãlcare a regulilor de concurenþã;- Economia abuzurilor de exploatare;- Economia instrucþiunilor privind concentrãrile economice non-orizontale;- Utilizarea metodelor econometrice în cazurile de concentrare economicã.

La reuniunea acestui grup de lucru au participat reprezentanþi ai DG Concurenþã, ai autoritãþilor de concurenþã din Statele Membre ale UE, precum ºi din România.Subiectele prezentate demonstreazã rolul din ce în ce mai important al utilizãrii principiilor economice în aplicarea politicii în domeniul concurenþei. Acest fapt se datoreazã creºterii numãrului de cazuri complexe, care au necesitat o analizã aprofundatã ºi riguroasã din punct de vedere economic.

•Participare la a doua Reuniune a Comitetului consultativ pentru

discutarea proiectului de Regulament privind exceptarea în bloc a

ajutorului de stat regional pentru investiþii, 26 septembrie, Bruxelles.

Within the hearing two main issues were debated:- EU energetic mix in the context of achieving three objectives: durable development, competitiveness and security supply; - European energy internal market, competitive and secured, in the benefit of the citizens and the industry of the European Union.

•Participation at the annual meeting of the ECN working group on

the Chief Economist in the field of competition, organized by DG

Competition of the European Commission , September, 21 - 23 Stockholm.

The working agenda of the meeting included the following issues:

- The private indemnities and the public benefits in the case of competition rules infringements;- The economy of the exploitation abuses;- The economy of the guidelines regarding the non-horizontal concentrations;- The use of the econometrical methods in the economic concentration cases.

Representatives of the DG Competition, of the competition authorities from the EU Member States, as well as from Romania attended the reunion of this working group.The approached issues prove the importance of using the economic principles in enforcing competition policy. This fact is due the increase of the number of complexes cases, which necessitated a deep and rigorous analysis from the economic point of view.

•Participation at the second Reunion of the Consultative Council on

debating the draft Regulation regarding the block exemption of the

regional State aid for investments, September, 26, Bruxelles.

Pe parcursul lunii septembrie activitatea privind diseminarea culturii concurenþei desfãºuratã de Consiliul Concurenþei a vizat cu precãdere autoritãþile publice centrale ºi locale, autoritãþile de reglementare sectorialã ºi mediul de afaceri.

Principalele acþiuni s-au concretizat în:

•participare la ºedinþa Consiliului Consultativ al Autoritãþii

Naþionale de Reglementare în domeniul Gazelor Naturale; au fost discutate aspecte specifice sectorului respectiv vizând mediul concurenþial;

•participare la întâlniri de lucru împreunã cu reprezentanþi ai

mediului de afaceri, autoritãþilor ºi instituþiilor, în cadrul cãrora au fost prezentate condiþiile necesare pentru implementarea corectã a legislaþiei specifice din domeniul concurenþei ºi ajutorului de stat;

•apariþia numãrului 3/2006 al revistei „Profil: Concurenþa”:

publicaþia cuprinde un numãr de 14 articole care trateazã, din punctul de vedere al concurenþei ºi ajutorului de stat, subiecte de interes precum: „Raportul anual al Consiliului Concurenþei-oglinda activitãþii anului 2005”, „O temã ºi un deziderat de permanentã actualitate: ajutoare de stat mai puþine ºi mai eficiente”, „Încãlcãri grave ºi foarte grave ale regulilor de concurenþã”, „Ajutorul de stat în contextul Organizaþiei Mondiale a Comerþului”.

La nivel local, Consiliul Concurenþei a organizat un numãr de 38 de

evenimente de promovare a culturii concurenþei, cu tematicã atât în domeniul concurenþei, cât ºi în al ajutorului de stat, dupã cum urmeazã:

•14 mese rotunde organizate de inspectoratele teritoriale de

concurenþã Alba, Braºov, Bacãu, Bucureºti ºi judeþul Ilfov, Caraº-Severin, Dolj, Galaþi, Harghita ºi Prahova; la aceste evenimente au participat agenþi economici din judeþe ºi reprezentanþi ai administraþiei publice locale;

•13 seminarii organizate de inspectoratele teritoriale de

concurenþã Arad, Bihor, Braºov, Buzãu, Constanþa, Dolj, Mehedinþi, Mureº, Olt, Tulcea, Vaslui ºi Vrancea; 6 dintre aceste seminarii s-au desfãºurat în colaborare cu camerele de comerþ ºi industrie locale, precum ºi cu sprijinul autoritãþilor publice locale;

During September the activity of disseminating competition culture carried out by the Competition Council focused mostly on the local and central public authorities, the sectoral regulatory authorities and the business environment.

The main actions were concretized in:

•attending the meeting of the Consultative Council of the

National Regulatory Authority in the field of Natural Gases; specific issues were debated involving the sector, issues with impact over the competitive environment;

•attending the working meetings with the representatives of

the business environment, authorities and institutions within which were presented the necessary conditions for a correct implementation of the specific legislation in the field of competition and State aid;

•publishing the issue no.3/2006 of the specific magazine

„Profile: Competition”: the publication includes 14 articles which approach, from the competition and State aid point of view, important issues as: “The Annual report of the Competition Council - the mirror of the 2005 activity”, “A permanent, actual theme and desideratum: Less and more efficient State aids”, “Serious and very serious infringements of the competition rules”, “State aid in the context of the World Trade Organization”.

At the local level, the Competition Council organized 38 de events on promoting the competition culture, focused on competition as well on State aid issues, as follows:

•14 round tables organized by the competition inspectorates

Alba, Braºov, Bacãu, Bucharest and the Ilfov County, Caraº-Severin, Dolj, Galaþi, Harghita and Prahova; at these events attended representatives of the local undertakings and of the local administration;

•13 seminaries organized by the competition inspectorates

Arad, Bihor, Braºov, Buzãu, Constanþa, Dolj, Mehedinþi, Mureº,Olt, Tulcea, Vaslui and Vrancea; 6 of these seminaries were organized in collaboration with the local chambers of commerce and industry and with the support of the local administration bodies;

•2 ateliere de lucru cu tema „Implicaþiile legislaþiei în domeniul

ajutorului de stat la nivelul autoritãþilor publice locale” organizate de Inspectoratul de Concurenþã Harghita, în cadrul cãrora au fost dezbãtute cu reprezentanþii a douã primãrii din judeþ anumite acte normative din domeniul ajutorului de stat, precum: Legea nr.571/2003 privind facilitãþile ce pot fi acordate din surse ale administraþiei locale, Legea nr.143/1999 privind ajutorul de stat, Hotãrârea de Guvern nr.490/2005 privind unele mãsuri pentru implementarea reglementãrilor privind ajutorul de stat.

De asemenea, experþi din cadrul inspectoratelor de concurenþã Constanþa, Braºov, Bucureºti ºi judeþul Ilfov, Harghita, Maramureº, Olt,

Sibiu ºi Vaslui au participat la 12 seminarii, simpozioane ºi

manifestãri specifice organizate de alte instituþii. Dintre subiectele tratate amintim: relaþia dintre fondurile structurale ºi ajutorul de stat, legislaþia specificã domeniului concurenþei ºi ajutorului de stat.

•2 workshops on “Implication of the State aid legislation at the

level of the local authorities” organized by the Competition Inspectorate Harghita; with these occasions certain normative act on State aid were debated with the representatives of two city halls from the counties, such as: Law no.571/2003 on the facilities which can be granted from the local administration resources, Law no.143/1999 on State aid, Government Decision no.490/2005 regarding certain measures for implementing the State aid regulations.

In addition, experts within the competition inspectorates Constanþa, Braºov, Bucharest and the Ilfov County, Harghita, Maramureº, Olt,

Sibiu and Vaslui attended 12 seminaries, symposiums and specific

events organized by other institutions. Among the approached issues we mention: the relation between the Structural Funds and the State aid and the presentation of the specific legislation in the field of competition and State aid.

Grupul de lucru pe problematica restructurãrii în domeniul

siderurgiei

Grupul de lucru „Task Force”

Reuniunea grupului de lucru a avut loc în data de 14 septembrie, la sediul Consiliului Concurenþei ºi a avut ca temã pentru dezbateri schemele de ajutor de stat ºi fondurile structurale.

Reuniunea a avut loc în data de 5 septembrie la sediul Ministerului Economiei ºi Comerþului unde au fost dezbãtute urmãtoarele probleme:

•evaluarea procesului de restructurare a industriei siderurgice

(prezentare a Proiectului Raportului nr.4 de monitorizare a procesului de restructurare a industriei siderurgice românesti, în vederea transmiterii spre analizã la Comisia Europeanã);

•impactul Planului Naþional pentru Alocarea certificatelor de emisii

de gaze cu efect de serã asupra evoluþiei industriei siderugice din România.

•participarea unui reprezentat al Consiliului Concurenþei la

Reuniunea Consiliului Competitivitate (COMPET), din data de

25 septembrie, Bruxelles.

Reuniunea s-a desfãºurat la sediul Consiliului European, punctele de maxim interes înscrise pe agenda de lucru fiind:

- Prezentarea de cãtre Comisia Europeanã a Comunicãrii intitulate „Transpunerea cunoºtinþelor în practicã: o strategie de inovare pentru Uniunea Europeanã” ºi schimb de opinii pe marginea acesteia;

- Prezentarea de cãtre doamna Neelie Kroes, Comisarul European în domeniul concurenþei, a ultimei variante a proiectului de Cadru de reglementare a ajutorului de stat pentru cercetare, dezvoltare ºi inovare, la care a participat domnul Marius Hirþe, Adjunct al ªefului Misiunii României la Uniunea Europeanã;

- Deliberarea ºi realizarea acordului politic asupra propunerii de Decizie a Parlamentului European ºi a Consiliului European privind programul comunitar de acþiune în domeniul protecþiei consumatorului;

- Informare din partea Comisiei Europene ºi dezbatere asupra dezvoltãrii Politicii privind Piaþa Unicã.

Inter-ministerial working group on State aid

Working group on the iron industry restructuring

“Task Force” working group

The reunion of the working group was organized on September, 14, at the headquarters of the Competition Council and was focused on debating the State aid schemes and the Structural Funds.

The reunion was organized on September, 5, at the headquarters of the Ministry of Economy and Commerce, the following issues being debated:

•The evaluation of the restructuring process of the iron industry

(presentation of the Draft Report no.4 for monitoring the restructuring process of the Romanian iron industry, in order to be transmitted for analysis to the European Commission);

•The impact of the National Plan for allocating the certificates for

curbing the greenhouse gas emissions over the evolution of the Romanian iron industry.

•Participation of a representative of the Competition Council at the

Reunion of the Competitiveness Council (COMPET), on

September, 25, Bruxelles.

The reunion was organized at the headquarters of the European Council, the most important points on the agenda being the following:

- Presentation by the European Commission entitled “Transposing the knowledge in practice: a strategy of innovating the European Union” and exchange of opinions on this issue;

- Presentation of Mrs. Neelie Kroes, the European Commissioner on competition, of the last project of the Regulatory framework of the State aid for research, development and innovation, attended by Mr. Marius Hirþe, Deputy Head of the Romanian Mission to the European Union;

- Deliberation and achievement of the political accord on the proposed Decision of the European Parliament and European Council regarding the Community action plan in the field of consumer protection;

Experþii Consiliului Concurenþei au participat la o serie de discuþii tehnice pe marginea programelor operaþionale, astfel:

•discuþii tehnice pe marginea Programului Operaþional Resurse

Umane, unde au fost dezbãtute aspectele legate de ajutorul de stat pentru universitãþi ºi pentru organizaþii non-guvernamentale;

•ºedinte de lucru pe marginea Programului Operaþional

Competitivitate, unde au participat reprezentanþii Ministerului Economiei ºi Comerþului, Agenþiei Naþionale a Întreprinderilor Mici ºi Mijlocii ºi Cooperaþie;

•discuþii tehnice cu reprezentanþii Ministerului Educaþiei ºi

Cercetãrii pe marginea Programului Operaþional Sectorial;

•întâlnire de lucru cu reprezentanþii Ministerului Comunicaþiilor ºi

Tehnologiei Informaþiei în legãturã cu schemele de ajutor de stat pentru care ministerul este Organism Intermediar pentru Programul Operaþional Competitivitate.

The experts of the Competition Council attended a series of technical discussions on the operational programs, as follows:

•technical discussions on the Operational Program Human

Resources, where were debated certain issues regarding the State aid for universities and for the non-governmental organizations;

•working meetings on the Operational Program Competitiveness,

attended by the representatives of the Ministry of Economy and Commerce, the National Agency for Small and Medium Sized Enterprises and Cooperation;

•technical discussions with the representatives of the Ministry of

Education and Research on the Sectoral Operational Program;

•working meeting with the representatives of the Ministry of

Communications and Information Technology regarding the State aid schemes for which the Ministry is Intermediary Body for the Operational Program Competitiveness.

•proiectul de Lege privind transportul în regim de taxi ºi de închiriere

Urmare a intervenþiilor Consiliului Concurenþei, prin actuala formã a proiectului Legii privind transportul în regim de taxi ºi de închiriere s-au pus bazele deschiderii pieþei. Au fost eliminate acele dispoziþii de naturã a restricþiona concurenþa, cum ar fi: intervenþia autoritãþilor publice locale pe piaþa serviciilor de taximetrie prin stabilirea numãrului maxim de autorizaþii taxi; impunerea de cãtre dispecerate a tarifului de transport operatorilor de taxi care utilizeazã serviciile lor, precum ºi limitarea în timp a funcþionãrii unui autovehicul.

•Aviz favorabil referitor la proiectul de Ordonanþã de Urgenþã

privind stingerea obligaþiilor cãtre bugetul consolidat al statului ºi a altor obligaþii ale SC Romaero SA prin trecerea unor bunuri din proprietatea acesteia în proprietatea publicã a statului ºi administrarea Serviciului Român de Informaþii.

Au fost transmise adrese conþinând clarificãri în domeniul concurenþei ºi ajutorului de stat, cãtre:

•SC Comsamo SRL cu privire la plângerea înaintatã de cãtre

acesta Consiliului Concurenþei cu privire la posibila exercitare a abuzului de poziþie dominantã a SC Transurb SA Galaþi;

•Societatea Comercialã de Distribuþie ºi Furnizare a Energiei

Electrice Electrica Oltenia SA cu privire la mãsurile de sprijin acordate SC ARO Câmpulung SA;

•Autoritatea pentru Valorificarea Activelor Statului cu privire la

mãsura de sprijin financiar acordatã SC Fabrica de Zahãr Bod SA din punct de vedere al legii privind ajutorul de stat;

•Parlamentul României - Senat - Comisia pentru Privatizare ºi

Administrarea Activelor Statului cu privire la mãsurile de sprijin pentru accelerarea privatizãrii SC Oltchim SA Râmnicu Vâlcea;

Interventions of the Competition Council

Clarifications

•draft Law on taxi and rental transportation

Following the interventions of the Competition Council, through the present form of the draft Law on taxi and rental transportation, the bases for opening the market were instituted. The dispositions restricting the competition were eliminated, such as: the local authorities' intervention on the market of taxi services by imposing the maximum number of taxi authorizations; the imposing of the transportation tariff by the taxi dispatch centers to the taxi operators which use theirs services, as well as the time limiting of a vehicle functioning.

•Favorable binding opinion regarding the draft Emergency

Ordinance regarding the erase of the debts to the State Consolidated Budget and of other obligations of SC Romaero SA by passing certain goods from its property into the State public property and into the administration of the Romanian Information Service.

Letters containing clarifications in the field of competition and state aid were sent to:

•SC Comsamo SRL regarding its complaint submitted to the

Competition Council regarding the possible abuse of the dominant position of SC Transurb SA Galaþi;

•Trading Company in the field of Distribution and Supply of Electric

Energy Oltenia SA regarding the support measures granted to SC ARO Câmpulung SA;

•Authority for State Assets Recovery regarding the support

measures granted to SC Fabrica de Zahar Bod SA (sugar processing unit) regarding the State aid law;

•Romanian Parliament - Senate - Commission for Privatization and

Administration of the State Assets regarding the support measures for accelerating the privatization of SC Oltchim SA Râmnicu Vâlcea;

•Ministerul Administraþiei ºi Internelor cu privire la proiectul de

Hotãrâre de Guvern privind repartizarea pe unitãþi administrativ-teritoriale a sumelor defalcate din taxa pe valoarea adaugatã pentru retehnologizarea, modernizarea ºi dezvoltarea sistemelor centralizate de producere ºi distribuþie a energiei termice;

•Agenþia Naþionalã de Administrare Fiscalã cu privire la

acordarea unui spijin financiar Companiei Naþionale a Uraniului Bucureºti în baza O.U.G. nr.8/2006;

•Consiliul Local al Municipiului Huºi cu privire la ajutorul de stat

acordat SC Goscomloc SA Huºi de cãtre Consiliul Local al Municipiului Huºi.

În cadrul investigaþiei care se deruleazã pe piaþa insulinei a fost

pentru încãlcarea prevederilor art.50 lit.c) din lege firma

Fildas Trading SRL pentru furnizare de informaþii inexacte ºi

incomplete cu .

Documentele pe care autoritatea de concurenþã le solicitã agenþilor economici în cadrul investigaþiilor au un rol important în efectuarea unei analize fundamentate ºi în adoptarea unei decizii corecte de cãtre Consiliul Concurenþei.

Au fost emise 4 decizii, din care:

•2 decizii privind operaþiuni de concentrare economicã;

•1 decizie de sancþionare pentru omisiunea notificãrii;

•1 decizie privind recalcularea taxei de autorizare.

Consiliul Concurenþei a sancþionat cu

societatea comercialã Flexiplast SA Piteºti pentru omisiunea notificãrii concentrãrii economice realizatã prin dobândirea controlului asupra SC DOW Automotive SA Budeasa Mare, jud. Argeº.

SC Flexiplast SA Piteºti avea obligaþia, conform prevederilor legale, de a notifica la Consiliul Concurenþei în termen de 30 de zile de la data semnãrii actului juridic în baza cãruia s-a realizat dobândirea controlului.

Government Decision on the allocation based on the administrative and territorial units of the sums deducted from the VAT regarding the improvement of the technology, the modernization and the development of the centralized production and distribution of heating energy;

•National Agency for Fiscal Administration regarding the grant of

a certain support for the Uranium National Company Bucharest, based on GEO no.8/2006;

•Local Council of the Huºi Municipality regarding the State aid

granted by the Local Council of the Huºi Municipality to SC Goscomloc SA Huºi.

Within the investigation which is carried out on the insulin market the

undertaking Fildas Trading SRL was for infringing the provisions stipulated by art.50(c) of the Law for supplying incorrect and

incomplete information with a .

The documents requested to the economic operators by the competition authority within the investigation carried out have an important role in undertaking a substantiated analysis necessary for the adoption of a correct decision by the Competition Council.

4 decisions were issued, of which:

•2 decisions regarding operations of economic concentrations;

•1 sanctioning decision for notification failure;

•1 decision regarding the recalculation of the authorizing fee.

The Competition Council sanctioned the trading company Flexiplast SA

Piteºti with for failure to notify the economic concentration carried out by acquiring direct control over SC DOW Automotive SA Budeasa Mare-Argeº County.

SC Flexiplast SA Piteºti had the obligation, according to the legal provisions, to notify to the Competition Council in 30 days from the date of the signing of the legal document based on which the control acquirement has been undertaken.

Potrivit prevederilor Legii concurenþei nr.21/1996, republicatã, omisiunea notificãrii unei concentrãri economice constituie contravenþie ºi se sancþioneazã cu amendã de pânã la 1% din cifra de afaceri totalã din anul financiar anterior sancþionãrii.
